This Privacy Policy (“Privacy Policy”) describes how Gordon Ramsay North America, LLC (“GRNA”, “we”, “us”, or “our”) collects, uses, maintains, shares, and otherwise processes information about you when you interact with us on our website,

We have collected the following categories of Personal Information about consumers. “Personal Information” or “Personal Data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Personal Information does not include information that is publicly available, de-identified, or aggregated.

Unless otherwise indicated, the below description also reflects our current practices. The Personal Information we collect about you may vary depending on the nature of your interactions with us and may not include all of the examples listed below.

HOW WE COLLECT PERSONAL INFORMATION

  • We collect information from you when you directly provide it to us, such as when you purchase a gift card, sign up for our E-Club newsletter, provide certain information to us in our restaurants, or engage with us through our social media accounts.
  • We and our third-party service providers collect information automatically about you. We use tracking tools to collect Internet or other electronic network activity information (such as Site usage information). We collect information about users over time when you use our Site.
  • We collect information about you from our vendors and partners. We may obtain information about you from our business partners, analytics or marketing providers or vendors that assist us in providing our services and running our internal business operations.

HOW DO WE DISCLOSE PERSONAL INFORMATION

We may disclose your Personal Information with affiliates, business partners, vendors (e.g., payment processors and website developers), and other parties. In the event of a business transaction, such as if we sell or transfer all or a portion of our business or assets (e.g., further to a merger, reorganization, liquidation, or any other business transaction, including negotiations of such transactions), we reserve the right to disclose any information we obtain through the Site and our services.

Please note our Site is not designed to respond to “Do Not Track” signals received from browsers. DATA SECURITY

We take reasonable measures to protect your Personal Information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. Nevertheless, transmission via the Internet is not completely secure, so we cannot guarantee the security of your information collected through the Site. 

CHILDREN’S PRIVACY

Our Site is not intended for use by children under the age of 13, and we do not knowingly collect Personal Information from children under the age of 13. If we become aware that we have obtained Personal Information from a child under age 13 we will delete such information in accordance with applicable law.

THIRD-PARTY LINKS

Our Site may contain links to features or websites that are not operated by GRNA, including social networks operated by unaffiliated parties. You may be asked by these websites to provide personal information or to release information you may have provided on our Site. Please be aware that this Privacy Policy does not apply to information collected through those websites. We are not responsible for the privacy practices of these websites, nor any adverse consequences that may result from your interaction with such third-party websites. We encourage you to be cautious when leaving our Site and to review the privacy statements of other websites.

HOW LONG WE KEEP YOUR PERSONAL INFORMATION

We keep Personal Information for as long as is necessary for the purposes described in this Privacy Policy or as otherwise authorized by law. This generally means holding the information for as long as one of the following apply: 

  • Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
  • Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected;
  • The Personal Information is reasonably required to protect or defend our rights or property; or
  • We are otherwise required or permitted to keep your Personal Information by applicable laws or regulations.

Please note that GRNA is based in the United States and that Personal Information we process may be transferred to a server in the United States. By submitting Personal Information to GRNA, you consent to this transfer, processing and storage. Please be aware that the data protection laws and regulations that apply to your Personal Information transferred to the United States or other countries may be different from the laws in your country of residence. 

ADDITIONAL CONSUMER PRIVACY RIGHTS

Certain states (such as California) have consumer privacy laws that provide their residents with certain rights related to their Personal Information. This Section supplements the other parts of our Privacy Policy and provides additional information for residents of these states, including how to exercise the rights available under the applicable state privacy laws. Capitalized terms defined in state privacy laws that are used in this Section shall have the same meaning as in the state privacy laws.

Disclosure of Personal Information

We may disclose the categories of Personal Information described in the “Personal Information We Collect And Why” section to our affiliates, service providers, and contractors for the following business purposes:

  • Services performed on our behalf (including processing, maintaining, or collecting Personal Information) related to the operation of our business and/or the Site and our services (for example, without limitation, website hosting, customer support, database management, web analytics, payment processing, marketing, or improvement of services)

The types of third parties to which Personal Information is sold or shared are third-party advertisers and analytics vendors. The purposes for which we sell/share this information include: showing you relevant ads while you browse the Internet or use social media, marketing, advertising, certain types of analytics, or similar purposes. We do not have actual knowledge that we sell or share the Personal Information of consumers under 16 years of age.

Submitting Requests Relating to Your Personal Information

Depending on your state of residency, you may have the right to submit certain requests relating to your Personal Information as described below. If you are a California resident who interacts with us as a consumer or a job applicant (collectively “California residents”), you have the right to submit requests relating to your Personal Information in accordance with the California Consumer Privacy Act (“CCPA”). Please note that, if you submit a request to know, request to delete, or request to correct, you may be asked to log into your account or to provide 2-3 pieces of Personal Information that we will match against our records to verify your identity. Depending on your state of residency, you may be able to designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed. An authorized agent may submit a request on your behalf using the email address or toll-free number listed above.

Your Privacy Rights

Right to Know. You may have the right to know what Personal Information we have collected about you, which includes: 

1. The categories of Personal Information we have collected about you, including

  1. The categories of sources from which the Personal Information was collected
  2. Our business or commercial purposes for collecting, selling, sharing, or disclosing Personal Information
  3. The categories of recipients to which we disclose Personal Information
  4. The categories of Personal Information that we sold, and for each category identified, the categories of third parties to which we sold that particular category of Personal Information
  5. The categories of Personal Information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of Personal Information

Right to Know Third Party Disclosures. You may have the right to request a list of third parties to which we have disclosed Personal Information.

Right to Delete Your Personal Information. You may have the right to request that we delete Personal Information we collected from you, subject to certain exceptions. 

Right to Correct Inaccurate Information. If you believe that Personal Information we maintain about you is inaccurate, you may have the right to request that we correct that information.

Right to Opt-Out of Sales and Sharing of Personal Information for Targeted Advertising. You may have the right to opt out of the sale of your Personal Information, and to request that we do not share your Personal Information for targeted or cross-context behavioral advertising. To opt-out, please use this link. If you choose to use the Global Privacy Control (GPC) browser signal, you will only be opted out of online sales or sharing of Personal Information, and will need to turn it on for each browser you use. 

Rights Related to Automated Decision-Making or Profiling. Rights Related to Automated Decision-Making or Profiling.  We do not use your Personal Information for purposes of automated decision-making or profiling for which these rights apply under current U.S. law.”

Right to Withdraw Consent or Limit Use of Sensitive Personal Information. If we process Sensitive Personal Information from you, you may have the right to withdraw a previously given consent for processing your Sensitive Personal Information for a specific purpose. We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.

Right to Appeal. Sometimes we are unable to process requests relating to your Personal Information, in which case, your request will be denied. If you have previously submitted a privacy rights request to us that has been denied and you believe we denied it in error, you may have the right to appeal for reconsideration of your request using our webform or toll-free phone number.

Please note that if you make a privacy rights request, we will retain the Personal Information submitted in connection with your request for recordkeeping purposes.

Right to Non-Discrimination for the Exercise of Your Privacy Rights. If you choose to exercise any of your privacy rights, you also have the right not to receive discriminatory treatment by us. 

CHANGES TO THIS PRIVACY POLICY

We may change this Privacy Policy from time to time. The most recent version of the Privacy Policy will always be posted on the Site, with the “Effective Date” posted at the top. Your continued use of the Site after any update to this Privacy Policy will constitute your acceptance of the changes.
